On Tuesday July 19, 2022, activists, organizations, legal providers, and allies met on the steps of Los Angeles City Hall to announce the launch of the Tenant Power Toolkit, designed to “keep people in their homes, fight evictions, fight rent debt, and build the collective power of tenants.” The toolkit was created by a coalition of housing justice organizations including The Debt Collective, The LA Tenants Union, and The Anti-Eviction Mapping Project. It gives tenants the ability to more easily reply to unlawful detainers, otherwise known as eviction notices. It also features a rent debt tool that allows tenants to figure out how much rent they owe, if their landlord is trying to collect rent illegally, whether they should apply to a rental assistance program, and how to fight back in small claims court. Ultimately, the Tenant Power Toolkit allows tenants to advocate for themselves more effectively, helping to even the playing field with landlords.
Oftentimes tenants lack the understanding and tools necessary to answer an unlawful detainer, which has led to many being wrongfully evicted from their homes. That’s why a key part of the Tenant Power Toolkit is the Eviction Answer Tool. In California, when a tenant is served an unlawful detainer, they must reply within five days in order to prevent the case from going into default in favor of the property owner. The Eviction Answer Tool allows tenants to automatically respond to their eviction by helping assess their case and filing an “Answer” through the court system. Tenants living in Los Angeles County can file the Answer directly from the toolkit website, while those residing outside of the county must print the Answer out and deliver it in person to their local courthouse.
Cherry Mullaguru, a staff attorney from Inner City Law Center, says the Eviction Answer Toolkit is important because “the tool lets the tenant raise the defenses applicable to their case, even if they’re not familiar with those protections themselves. The reason this is so critical is that any defense a tenant may have for their eviction has to be raised in their answer.”

Kit de Herramientas de Poder para Inquilines, diseñado para “mantener a las personas en sus hogares, luchar contra los desalojos, luchar contra la deuda de renta y construir el poder colectivo de los inquilinos”. El conjunto de herramientas fue creado por una coalición de organizaciones de justicia de vivienda, incluidas El Colectivo de la Deuda, La Unión de Inquilinos de Los Ángeles y El Proyecto de Mapeo de Anti-Desalojo. Esta herramienta brinda a los inquilines la capacidad de responder más fácilmente a las detenciones ilegales, conocidas como avisos de desalojo. Es por eso que una importante parte del Kit de Herramientas de Poder para Inquilines es la herramienta de Respuesta de Desalojo. En California, cuando a un inquiline se le notifica una orden de detención ilegal, debe responder dentro de cinco días para evitar que el caso automáticamente vaya en favor del dueño de la propiedad. La herramienta de respuesta de desalojo permite a los inquilines responder automáticamente a su desalojo al ayudar a evaluar su caso y presentar una “Respuesta” a través del sistema judicial. Los inquilinos que viven en el condado de Los Ángeles pueden presentar la respuesta directamente desde el sitio web del kit de herramientas, mientras que los que residan fuera del condado deben imprimir la respuesta y entregarla en persona en el juzgado local.
Cherry Mullaguru, abogada de Inner City Law Center, dice que la Herramienta de Desalojo del kit es importante porque “la herramienta le permite al inquiline presentar las defensas aplicables a su caso, incluso si no están familiarizados con esas protecciones. La razón por la que esto es tan crítico es que cualquier defensa que un inquiline pueda tener para su desalojo debe plantearse en su respuesta”.
